Terms & Conditions

These business-to-business terms cover how SalesGamez may be used, what each side is responsible for and the law that applies.

Last updated 30 September 2026.

1.Who we are and how to reach us

The Service is operated by SalesGamez, 80A Ruskin Ave, London, DA16 3QQ, United Kingdom. General, legal and security enquiries can be sent to hello@salesgamez.com, and privacy and data protection enquiries to privacy@salesgamez.com, or use the contact form on this website.

These terms form the agreement between us and the business that subscribes to the service, called you or the Customer, and they apply every time the service is used.

2.Definitions

Service means the SalesGamez website, application, games, boards, exports and related support. Sales Gamez means the live competition games built around sales targets and team performance. Entertainment Gamez means the optional additional games for entertainment and wider participation. Site means one physical location of your business for which a subscription is held. Active Player means a named individual taking part in a live Sales Gamez competition. Viewer means anyone who only watches a board or shared link. Customer Content means everything you or your users upload or enter, including team names, badges, player names, photographs and figures. Order means the plan, billing frequency and any hardware you select at sign-up or as later agreed. Subscription Period means the monthly or annual period your Order covers.

3.The documents that make up the agreement

The agreement consists of these terms, your Order, our Privacy Policy, Cookie Policy, Data Processing Agreement, Subprocessor Disclosure and Intellectual Property Policy. If there is a conflict, the Order prevails over these terms in respect of the plan, price and billing frequency. The Data Processing Agreement prevails on the processing of Customer Data. The Intellectual Property Policy prevails on questions of ownership and permitted use. Otherwise these terms prevail over the policies.

Any purchase order, terms on a supplier portal, or other document you issue has no effect unless we agree to it in writing.

4.How the contract is formed

You submit a registration for a Site. The contract begins when we confirm the registration and enable the account, or when the Service is first made available to you, whichever is earlier. A registration is an offer that we may accept or decline.

By registering you confirm you are acting for a business, that you are at least 18, and that you have authority to bind that business. The Service is supplied for business use only. It is not offered to consumers, so consumer cancellation rights do not apply. Nothing in these terms affects statutory rights that cannot lawfully be excluded.

5.The Service and what it is not

SalesGamez provides competition boards and games for sales floors and teams. All figures shown on a board are entered manually by your own people, so the accuracy, fairness and lawfulness of anything displayed is your responsibility.

The Service is not a source of financial, employment, commission or payroll truth and must not be relied on as a record for pay, discipline, bonus calculation or legal purposes. It is not advice of any kind. We may add, change, improve or retire games and features, and will not make a change that materially reduces core functionality without giving you reasonable notice. Where a feature is described as new, beta or preview, it is provided as it stands and may change or be withdrawn.

6.Accounts, roles and security

A master account creates and approves accounts. Each admin sets up their own Site, teams and players. New accounts start on a temporary password that must be changed at first sign-in.

You may create an account and sign in either with an email address and password or by using your existing Google or Microsoft account. The Google and Microsoft sign-in applications are registered to SalesGamez in our own name, so the permission screen names SalesGamez. We request only your email address, basic profile name and a provider account identifier in order to create and identify your account, and we never receive your password or access to your mailbox, contacts, calendar or files. Your use of Google or Microsoft to sign in remains subject to that provider’s own terms, which we do not control. You remain responsible for the security of the Google or Microsoft account you choose to use, and if you lose access to it you should set a password on your SalesGamez account instead. A Google or Microsoft account can only be used to reach a SalesGamez account that already exists for that email address.

You must keep sign-in details confidential, must not share a single login between people, must remove access promptly when someone leaves, and are responsible for all activity under your accounts, whether or not authorised. We may detect and suspend shared or compromised logins, and may require a password reset where security requires it. Tell us immediately at privacy@salesgamez.com if you suspect unauthorised access.

7.Sites, allowances and viewers

A subscription covers one physical Site. Departments within the same building are one Site. Separate buildings need separate subscriptions. Remote colleagues watching a board are Viewers and are unlimited, with no login required.

Your plan sets the number of Active Players permitted. Guest players in Entertainment Gamez do not count towards that allowance. If your usage exceeds the plan you hold, we will ask you to move to the correct plan. We may limit the addition of further players until you do, and we may charge the difference in fees from the date the allowance was exceeded. You must not attempt to spread one subscription across multiple businesses, franchises or locations.

8.Customer Content and instructions

Customer Content remains owned by the Customer or its licensors. The Customer grants SalesGamez a non-exclusive, worldwide, royalty-free licence for the subscription term to host, copy, transmit, format and display Customer Content only as necessary to provide, secure and support the Service, comply with the Customer’s documented instructions, and meet legal obligations.

The Customer is responsible for the legality, accuracy and quality of Customer Content and warrants that it has all rights and lawful bases necessary to enter, use and display it. This includes names, performance figures and optional photographs of people who may not have a SalesGamez login.

The Customer must not instruct SalesGamez to process personal data unlawfully. If SalesGamez reasonably believes an instruction infringes applicable data protection law, it will inform the Customer unless prohibited by law and may suspend the affected processing until the parties resolve the issue.

SalesGamez does not routinely monitor Customer Content but may restrict or remove content where reasonably necessary to comply with law, protect people or systems, or enforce these Terms.

9.Acceptable use

The Customer and its users must not use the Service unlawfully, fraudulently or in breach of another person’s rights; to bully, harass, humiliate, intimidate, discriminate against or unfairly single out any person; for excessive or covert workplace monitoring; to make a solely automated decision producing legal or similarly significant effects; to upload data that is not relevant and necessary, including special-category, criminal-offence or children’s data, unless SalesGamez has expressly agreed in writing; to publish a board or photograph beyond an audience for which the Customer has a lawful basis and has given appropriate notice; to operate an unlawful lottery, gambling arrangement, prize competition or promotion; to upload defamatory, obscene, malicious or infringing content; to probe, overload, disrupt, circumvent or test the Service or its security without written authorisation; to introduce malware, scrape data, reverse engineer, resell, rent, sublicense or provide the Service to third parties except as expressly permitted; to share credentials; or to misrepresent identity, usage or subscription allowance.

SalesGamez may remove content or suspend affected access where it reasonably believes this clause has been breached, using measures proportionate to the risk and providing reasons unless law or security needs prevent it.

11.Hardware

The SalesGamez TV stick is coming soon and is not currently available to order or charged as part of any subscription. The Service works on a compatible screen using its browser, an existing streaming device or a connected computer, so no SalesGamez hardware is required to start. Any future hardware offer will have separate ordering, pricing, delivery and warranty terms shown before purchase.

12.Fees, payment and price changes

Fees are those shown on the pricing page or in your Order. Monthly plans are payable in advance each month. Annual plans are payable in full upfront at the price shown. Entertainment Gamez, where selected, is billed on the same date and for the same period as your Sales Gamez plan. Hardware is not currently available to order and is never charged. SalesGamez is not currently registered for VAT, so no VAT is added to the prices shown. If that changes, any tax due will be shown at checkout before you pay.

Payment is due on the invoice or renewal date using the saved payment method. If a recurring payment fails, we notify the account owner by email and in the app and access is suspended immediately until the payment method is updated or payment is completed. Access is restored after payment clears. This does not waive the amount due. We may also charge statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998 where it applies, together with reasonable recovery costs.

We may change prices with at least 30 days’ written notice, effective from your next renewal. If you do not accept a change you may cancel before it takes effect. Fees paid are not reduced by non-use of the Service.

13.Free trial and Entertainment Gamez

New Sites receive a free trial of seven calendar days covering everything selected at registration. Valid payment details are required to start the trial. No amount is taken during it. At the end of the seventh day the plan you selected starts automatically and is charged to that payment method, unless you have cancelled before then. One free trial is available per Site. A free trial only counts as used once it has actually begun, so opening or revisiting the payment page without starting a trial does not use it up.

Because only one free trial is available per Site, a Site that has already started a free trial cannot receive another one. If the subscription is cancelled and the same account later chooses a plan again, the subscription begins immediately and the first payment is taken when the payment details are submitted. If the Site record is deleted, either by the account owner closing the account or by SalesGamez, any later registration using the same email address is treated as a new Site and is eligible for a new free trial.

Entertainment Gamez is optional and is not selected by default. If you include it, it forms part of the same subscription and is billed on the same date and for the same period as your Sales Gamez plan, at £50 monthly or £500 annually. You may remove Entertainment Gamez at any time, including during the free trial, in which case it is never charged and only Sales Gamez continues. Cancelling Sales Gamez ends the whole subscription, including Entertainment Gamez.

14.Term, cancellation and what happens to data

Subscriptions renew automatically until cancelled. A monthly plan can be cancelled at any time. It will not renew and access continues until the end of the month already paid for. An annual plan can be cancelled at any time. It will not renew and access continues until the end of the annual period already paid for. Entertainment Gamez can be removed on its own at any time and continues until the end of the shared paid period. Cancelling Sales Gamez ends everything, including Entertainment Gamez. Cancelling during the seven-day free trial stops the subscription before any charge is taken. Cancellation is self-service in the subscription and payments area of the account, takes effect without further steps, and is confirmed by email stating the date access ends and that no further payment will be taken. Cancellation does not create a partial refund for unused time. Fees already paid are non-refundable except where the law requires otherwise or where we have materially breached these terms and failed to remedy it.

The account owner may also close the account entirely at any time, whether or not a subscription is running, using the close-account control in the subscription and payments area. Closing the account cancels any remaining subscription immediately and permanently deletes the Site, its users, its Customer Content and the associated billing customer record from our active systems, without any further request or approval being required. Closure is immediate and irreversible, so any invoices or Customer Content that are still needed should be downloaded beforehand. Because no record of the closed Site remains in our active systems, a later registration using the same email address is treated as a brand new Site and is eligible for a new seven-day free trial. Closure is confirmed by email to the account owner’s address, stating that any remaining subscription has been cancelled and that the account details have been deleted. Closure does not refund fees already paid for the current period.

If payment fails, access is suspended immediately as set out in the Fees and payment clause. Payment during or after suspension restores access once it clears. We may terminate immediately for a material breach that is not remedied within 14 days of written notice, a serious breach of acceptable use, insolvency or cessation of trade. We may also choose not to renew by giving 30 days’ notice before the end of a period, refunding any part of a period paid for but not provided.

Where the account owner uses the close-account control, deletion from active systems happens immediately, so anything still needed must be downloaded first. Where SalesGamez closes an account for another reason, such as non-payment or a written request from the Customer, the account and Customer Data are kept for no more than 30 days so that they can be recovered or supplied to the Customer, then securely deleted or irreversibly anonymised from active systems, unless law requires longer retention. There is no automated export yet, so a copy of Customer Data must be requested from privacy@salesgamez.com before closure or within that 30-day period.

Deleted data may remain in protected rotating backups for no more than 90 days after active-system deletion. It is not used for ordinary business purposes and, if restored, must be deleted again. Billing, invoice and tax records are kept by SalesGamez and its payment provider for as long as tax and accounting law requires, normally six years after the end of the relevant financial year, even where the Site itself has been deleted. Clauses intended to survive termination, including fees already due, liability, indemnity, confidentiality, data protection and intellectual property, continue to apply.

15.Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free operation and do not offer a contractual uptime figure. Planned maintenance is carried out outside normal UK business hours where practicable, with reasonable notice for anything likely to cause noticeable disruption. Third-party outages, internet faults and events outside our reasonable control can interrupt access.

Support is provided by email during normal UK business hours, and we aim to respond within one working day. Support covers the Service itself. It does not cover your own network, screens, devices or internet connection.

16.Data protection

Each party will comply with applicable data protection law. SalesGamez acts as controller for its own account, billing, support, security, limited service-operation and any future lawful marketing processing, as described in the Privacy Policy.

For Customer Data, the Customer is controller and SalesGamez is processor. The Data Processing Agreement at /dpa is incorporated into these Terms and takes priority over inconsistent provisions concerning processing of Customer Data. The Subprocessor Disclosure at /subprocessors identifies approved subprocessors and the applicable change process once provider details are confirmed.

The Customer must establish and document a lawful basis, provide required notices, handle data-subject requests and objections, keep data accurate and proportionate, complete any required DPIA, and comply with employment and equality law. SalesGamez will provide the assistance specified in the Data Processing Agreement.

17.Games, prizes, rewards and gambling compliance

SalesGamez supplies software for displaying games and performance information. It does not sponsor, administer, fund, select or deliver any prize or reward offered by a Customer unless expressly agreed in a separate written contract.

The Customer is solely responsible for designing and operating each incentive, prize, bonus, reward, draw or promotion lawfully and fairly. This includes publishing clear eligibility, scoring, tie-break, prize and closing rules; ensuring results and winner selection are accurate and auditable; obtaining any internal approvals; complying with employment, equality, anti-bribery and sector-specific rules; accounting for income tax, PAYE, National Insurance contributions, reporting and any other tax consequences of cash, vouchers, benefits or prizes; ensuring participation and award criteria do not create unlawful discrimination or contractual pay obligations; and obtaining specialist advice before using chance, paid entry, employee contributions, deductions, purchases or other features that could constitute unlawful gambling, a lottery or a regulated prize promotion.

The Customer must not use SalesGamez to run an unlawful lottery, betting arrangement or other regulated gambling activity. SalesGamez does not determine whether a Customer’s promotion is lawful and does not provide tax, employment or gambling-law advice.

18.Confidentiality

Each party will keep the other’s confidential information confidential, use it only for the purposes of this agreement, protect it with at least reasonable care, and disclose it only to those who need it and are under equivalent duties. This does not apply to information that is public through no breach, was already known without obligation, is independently developed, or is required to be disclosed by law, a court or a regulator, in which case the disclosing party will give notice where it lawfully can. These duties continue for three years after the agreement ends, and indefinitely for anything that is a trade secret.

19.Our intellectual property

The SalesGamez Intellectual Property Policy forms part of these terms. As between SalesGamez and you, SalesGamez and its licensors own all rights, title and interest in the Service and its original materials, including the brand, software, code, interface and board designs, and each original game as expressed through its artwork, wording, rules, layouts, sequences and presentation. This also includes illustrations, photographs, generated artwork, animations, audio, music, sound effects, videos, documents, templates, written content, compilations, adaptations and updates created or commissioned for SalesGamez, together with copyright, database right, design right, trade marks and any other intellectual property rights in them. All rights are reserved.

Your plan gives you only a limited, revocable, non-exclusive, non-transferable and non-sublicensable right to use the Service for your own internal business purposes for as long as the plan continues. It does not transfer ownership. Except where applicable law expressly permits and that right cannot be excluded, you must not copy, reproduce, extract, scrape, republish, modify, distribute, resell, sublicense, reverse engineer or create derivative or competing products from the Service or its materials, remove ownership notices, or use those materials as input or training data for any artificial-intelligence or machine-learning system, without our prior written permission. We expressly reserve our rights in respect of text and data mining.

20.Third-party names, brands, landmarks and intellectual property

The Service may include photographs, illustrations, names, references or other depictions of real-world locations, landmarks, buildings, destinations, organisations, products, brands or other third-party property, included for descriptive, identification, geographical, artistic and entertainment purposes in connection with the games.

Unless expressly stated otherwise, SalesGamez is an independent product and is not affiliated with, associated with, authorised by, sponsored by or endorsed by the owners, operators, architects, designers, licensors or other rights holders of any landmark, location, building, organisation or brand depicted or referenced within the Service.

Any third-party names, trade marks, logos or other intellectual property appearing within the Service remain the property of their respective owners, and their appearance does not imply any commercial relationship, partnership, sponsorship or endorsement. Where third-party signage or branding appears incidentally within a depiction of a real-world location, it is there solely to represent or identify that location. References to routes, cities, destinations and landmarks provide a themed visual journey and do not indicate any connection with any tourism authority, landmark operator or brand owner. SalesGamez does not claim ownership of any third-party intellectual property displayed or referenced within the Service.

21.Feedback

If you send us suggestions or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without obligation, payment or attribution, and we may develop features based on it without owing you anything. We will not identify you as its source without your agreement.

22.Warranties

We warrant that we will provide the Service with reasonable care and skill and in accordance with these terms, and that we have the right to grant the rights we grant.

Apart from those warranties, and to the fullest extent the law allows, all other terms, conditions and warranties implied by statute or common law are excluded, including any implied warranty of satisfactory quality or fitness for a particular purpose, or that the Service will meet your requirements, be free from defects, or produce any particular commercial, motivational or financial result.

23.Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that, neither party is liable for loss of profit, revenue, business, contracts, anticipated savings, goodwill or reputation, for loss or corruption of data beyond our data-protection obligations, for wasted management time, or for any indirect or consequential loss, however arising and whether or not foreseeable.

Subject to the first paragraph, our total liability in connection with this agreement, whether in contract, tort including negligence, misrepresentation, restitution or otherwise, is limited in any 12-month period to the fees you paid in that period. Each limit applies to the total of all claims in that period.

You remain responsible for how you use the boards in relation to your own staff, including any employment, morale or data protection consequences, and for the accuracy of what you enter.

24.Indemnity

You will indemnify us against claims, losses, damages, fines and reasonable costs, including reasonable legal fees, arising from Customer Content, from your use of the Service in breach of these terms or applicable law, from a third party’s claim that Customer Content infringes their rights, or from a claim by one of your staff or a regulator relating to what you chose to display. We will notify you promptly of any such claim, let you take reasonable control of the defence and give reasonable assistance at your cost, and will not settle without your consent.

25.Suspension

We may suspend all or part of the Service immediately where necessary to protect the Service or other customers, to deal with a security incident, where required by law or a regulator, where fees are overdue, or where we reasonably suspect a serious breach of the acceptable use clause. We will tell you why, keep any suspension no wider and no longer than necessary, and restore access as soon as the reason is resolved. Suspension for your breach or non-payment does not entitle you to a refund or extension.

26.Events outside our control

Neither party is liable for failure or delay caused by an event beyond its reasonable control, including utility or internet failure, hosting provider outage, cyber attack, fire, flood, severe weather, epidemic, industrial action, terrorism, war or government action. The affected party will notify the other and use reasonable efforts to reduce the impact. If such an event continues for more than 30 days, either party may terminate on written notice, and we will refund fees for any period paid for but not provided.

27.Lawful conduct and compliance

Each party will comply with applicable law in performing this agreement, including the Bribery Act 2010, the Modern Slavery Act 2015 where it applies to that party, applicable sanctions and export controls, and equality and employment legislation relevant to how the Service is used with staff. Neither party will offer or accept a bribe or facilitation payment in connection with this agreement. You confirm you are not subject to sanctions that would make supplying you unlawful.

28.General

You may not assign, novate or transfer this agreement without our written consent, which will not be unreasonably withheld. We may assign it as part of a sale or reorganisation of our business. We may use subcontractors and remain responsible for their performance.

Notices must be in writing and sent to the email addresses the parties use for account correspondence, and are treated as received on the next working day. These terms, together with the Order and the policies listed above, form the entire agreement and replace any earlier discussions, representations or proposals, except that nothing excludes liability for fraudulent misrepresentation.

A delay in enforcing a right is not a waiver of it, and a waiver must be in writing. If any provision is unenforceable it will be modified to the minimum extent necessary or removed, and the rest continues in force. Nothing creates a partnership, agency, joint venture or employment relationship. Neither party may use the other’s name in publicity without written consent. No one other than the parties may enforce these terms under the Contracts (Rights of Third Parties) Act 1999. Anything requiring agreement in writing includes email from an authorised representative.

29.Complaints and disputes

Please raise any complaint with us first at hello@salesgamez.com. We aim to acknowledge within two working days and resolve matters promptly. If a dispute cannot be resolved, senior representatives of each party will discuss it in good faith, and the parties will then consider mediation before starting proceedings. Either party may seek urgent injunctive relief, or take steps to recover an undisputed debt, at any time.

30.Changes and governing law

We may update these terms and will publish the new version here with its effective date. Material changes take effect at your next renewal, or on 30 days’ notice, and continued use after that means you accept them. Where a change materially disadvantages you, you may cancel before it takes effect.

These Terms and any non-contractual obligations arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where the parties agree another forum in an Order.
